GENERAL CONDITIONS OF USE OF THE STEVANATO GROUP DATAPLUS PLATFORM

  1. These general conditions of use (the “General Conditions”) provide for the terms and conditions of use, browsing and access to the Stevanato Group DataPlus platform at dataplus.stevanatogroup.com (the “Platform”) and apply to any user (a “User”) who accesses to the Platform.
  2. The Platform is managed by Stevanato Group S.p.A., with registered offices at Piombino Dese (Padua – Italy), via Molinella 17 (“Stevanato”).
  3. These General Conditions provide for the terms and conditions to which each User shall mandatorily adhere before any access, browsing and use of the Platform, and the access to and use of the Platform by a User is based on the assumption that these General Conditions have been accepted by the User.
  4. Access to the Platform is reserved for adults who are at least 18 years old.
  5. To access the Platform, the User will have received an invitation from Stevanato with a link to register and create login credentials, which will be strictly personal of the User. The User is responsible for the diligent guard of the log-in credentials and the safeguard their secrecy. Stevanato shall not be considered liable for any use of the Platform by any of Users that is not compliant with the laws and regulations in force. Each User will specifically be liable for communicating information or data which is incorrect, false or concerning third parties without the latter’s consent, as well as for any improper use of such data or information.
  6. Through the browsing of the Platform the User acquires limited rights to access, use and disclose information and documentation on Stevanato Group products as strictly regulated by the non-disclosure and confidentiality agreement (“NDA”) entered into among Stevanato and the company where the User is employed. By accepting these General Conditions, the User acknowledges the content of the NDA and declares to adhere to is as well as to browse the Platform and use the information and documents present on the platform in strict compliance with the provisions of the NDA.
  7. Each User undertakes to use the Platform in a responsible manner. To this end, it is prohibited in particular to: (i) hinder or interrupt access to or operation of the Platform, (ii) attempt to probe, scan or test the vulnerability of the system or network vulnerability, or breach security or authentication without having received authorisation to do so, or (iii) attempt to access confidential data and private servers of Stevanato which are not intended for the Users, or (iv) interfere with the access and peaceful use of the Platform by any other User, or (v) access to the Platform and use the information and document provided therein for a use other than the one prescribed in the NDA.
  8. Stevanato may amend or update all or part of these General Conditions. Any amendments or updates to the General Conditions will be binding upon publication in this section of the Platform. Stevanato therefore ask that any User regularly access this section to check for the publication of the most recent and up-to-date General Conditions. If a User does not agree to all or part of the General Conditions, the User shall not use the Platform.
  9. Each User accepts that Stevanato may at any time revoke the User’s authorization to access and browse the Platform, for any reason or no reason and/or with no prior notice. Each User moreover acknowledges and accepts that the information and document present in the Platform may be removed or modified at any time by Stevanato.
  10. All contents present in the Platform, including but not limited to, works, images, pictures, documents, methods, processes, functions, software, drawings, figures, logos and any other material published on the Platform and are protected by copyright and by all other intellectual property rights of Stevanato and the relevant rights holders. The Platform will not allow Users to download documents. However, a tracking system will be in place to monitor the pages viewed by each User. Moreover, any other reproduction, wholly or in part, and in any form whatsoever (including through screenshots or photos), is strictly prohibited unless previously authorized in writing by Stevanato.
  11. Stevanato does not warrant that the information published on the Platform is accurate, complete or free from error. The User Party agrees that Stevanato shall have any liability to the User or the User’s company resulting from the use of the information present in the Platform or any errors therein or omissions therefrom.
  12. To the extent permissible by law, Stevanato assumes no responsibility for information published on the Platform and disclaims all liability in respect of such information. Stevanato is not liable for any injury and/or damage to persons or property as a result of any actual or alleged libellous statements, infringements of intellectual property or privacy rights, or product liability, whether resulting from negligence or otherwise, including without limitation, from any use or operation of any ideas, instructions, procedures, products or methods contained in the material published on the Platform.
  13. These General Conditions are governed by Italian law.
  14. The Court of Padova (Italy) shall have exclusive jurisdiction for any dispute between a User and Stevanato arising from these General Conditions.
